Epic Games CEO Tim Sweeney shared an update on the ongoing Epic vs. Apple lawsuit on August 11, 2026. In his post, he shared fresh details regarding the 27% commission fee that has been imposed by Apple.
Epic vs. Apple Lawsuit Reaches Final Stage as Court Stay Denied
Following the high court’s decision to decline to hear the antitrust case in 2024, it allowed developers to use alternative payment methods. However, Apple kept the 27% commission fee for its own payment gateway.
In 2025, during the Epic vs. Apple Fortnite dispute, the former party argued that this violated court orders. Following this, an injunction was put on the 27% commission fee and was stopped. Amid the commotion, Fortnite returned on iOS devices, marking a major turning point.
Fast forward to today, August 12, 2026, Apple’s stay has been denied. This is what Tim Sweeney had to say: “Apple’s stay was denied! Now they have 24 hours to file their proposed menu of junk fees with the Court, and Epic will have 60 days to file our legal analysis in advance of a court hearing on the topic.”
Although the Epic vs. Apple Lawsuit is far from over, Tim Sweeney is confident that Apple has little to no rebuttal. This is based on the fact that Apple will have 24 hours to compile facts and figures with the court.
Tim further went on to say: “Will Apple honestly document their costs for human reviewer time and seek to recoup them? Or fabricate outlandish new notions of cost previously unknown to mankind? Tune in 24 hours from now to find out.”
An update on the matter is expected briefly, but the final verdict will still take time. Nevertheless, Tim Sweeney is confident that this is the endgame for the Epic vs. Apple lawsuit. The verdict could be out before Fortnite Chapter 7 Season 4 ends.
Lastly, when asked by a fan how this would affect Fortnite on macOS, he stated: “We are rapidly approaching an endgame that will determine that one way or another.” This is rather vague at the moment, and without the verdict, the potential agreement that could be reached by both parties is unknown.
On a lighter note, the CEO once more reminded the community that if Epic Games wins, everyone will be given a free skin. This could be part of the list of Fortnite skins that will work in Roblox, but it is far too soon to tell.
